Bonaire Election Results
The ink was barely dry on the ballots last Friday evening when the final Bonaire election results were tallied and the seats in the next Eilandsraad (Island Council) were determined. The end result was that Red Party (PDB - Partido Demokratiko Boneriano, also known as the Democrats) had won four seats (down from five during the previous election), the Green Party (UPB - Union Patriotiko Boneriano) also won four seats (up from two in the previous election), and the Yellow Party (PABOSO - Partido Boneriano Sosial) got one seat (down from two).

In order for the Eilandsraad to operate, there must be one or more parties willing to work together, controlling at least a simple majority of the seats (five seats, at a minimum). As none of the parties in the elections won the five seats they needed, it pointed to the need for a coalition government, and over the weekend, the Green and Yellow Parties worked out their differences, and then announced that they would indeed combine their seats to form a coalition. This spells a potentially significant change, as the Red Party, which had been in power, is now no longer in control of the government.

Among the areas that the new coalition has committed to publicly is the creation and implementation of an economic reform program, but there are no significant details of what such a program would look like. One point of contention between the Green and Yellow Parties, however, has been that the Green Party has been advocating larger autonomy for Bonaire from the Netherlands Antilles and Curaçao, while the Yellow Party wants to keep the five islands of the Netherland Antilles together, while helping move Bonaire in the direction of being a duty free haven.

The Eilandsraad will change hands and membership on July 2nd, and the new members of the Eilandsraad will be announced before then.

In terms of voter turnout, there were 8,301 eligible voters, of which 6,619 actually voted, representing an astounding (at least for us Americans) 80% turnout. Of the 6,619 cast votes, 131 were deemed invalid because of one of the following: the ballot was returned blank; the ballot was marked with a different pencil than was issued for marking; extra remarks on the ballot; or ballot included votes for more than one candidate.

The votes cast per party are as follows:

  • Red (PDB)  2,762 votes
  • Green (UPB)  2,613 votes
  • Yellow (PABOSO) 1,042 votes
  • Blue (POB)  66 votes

Special Days Ahead
We warned you last week that the last day of April and first day of May are full of activities on Bonaire, and we're still right about that. However, what we got wrong, was that April 30th, which is the holiday known as Koninginnedag (Queen's Day) was in honor of the birthday of Queen Beatrix. One of our more attentive readers (thanks Whitney!) pointed out that this was not quite right. In fact, the Queen's Day is in honor of Queen Bea's mom, Princess Juliana (formerly Queen Juliana), who turns 90 this week. Our apologies to both their majesties and we'll be sure to raise a glass on Friday to honor Princess Juliana.

During Queen's Day and Labor Day (May 1st), most Bonairean stores, shops, and businesses, including banks and supermarkets, will be closed, so expect long lines on Thursday.

Below is an updated list of events for the coming special days ahead:

- Rincon Day (or Dia di Rincon in Papiamentu) is held on Friday, April 30th, and all of Rincon will be hoppin' with non-stop music, food, socializing, and colorful and festive presentations by the residents of Rincon. This is a great time to enjoy a beautiful town that most of us on Bonaire visit all too infrequently. The festivities start in the morning and go on well into night.

- Dive Inn, a dive operation located just south of the customs pier, at Playa Chachacha, will be sponsoring several underwater competitions on April 30th and May 1st. On April 30th, they are featuring the "Estafette Dive", where you can practice different skills in an under water game-circuit. On Saturday, May 1st, there's the "Snorkel Fun" event, which you compete to see how long you can stay under water through a game circuit. Both of these events will be held in front of Dive Inn. - On May 1st, Labor Day (also a holiday on which most businesses are closed),  the Aliansa Naturalesa Boneiru (Nature Alliance Bonaire) and STINAPA will organize a Cultural and Nature Exhibition at the Mangasina di Rei and Rancho Don Pedro, near Rincon. Everyone on Bonaire is invited to join this cultural event. It will be held from 10am - 10pm, with the following schedule:

     10.00 - 16.00: Expo of artifacts, produce from Kriabon and LVV
     12.00 - 17.00: Information booths by Aliansa Naturalesa Boneiru
     12.00 - 17.00: Cold drinks and cold beer for sale
     12.00 - 14.00: Opportunity to buy kuminda krioyo
     12.00 - 14.00: Music by Piedra di Boneiru
     12.00 - 17.00: Folkloric music by Proyecto 2000
     14.00 - 16.00: Wheel of Fortune (9 rounds)
     13.00 - 16.00: Games for Children
     16.00: Departure of folkloric parade towards Rincon
     18.00: Arrival of parade at the monument near Rancho Pedro
                (at the beginning of the road to Washington Park)
     19.00 - 22.00: Music and dancing in the corral of Rancho Pedro

- May 1st is also the first day of the International Blue Marlin Tournament, which starts at 7am at Harbour Village. The awards ceremony will be held at the Harbour Village Marina at 6:15pm on Sunday, May 2nd. Call Chris at 8774 for details.

- And, May 1st is also the date of the third MegaCity party, co-sponsored and organized by Mega FM and City Café. This year's party title is "Rolling Stars 99", which looks back on 30 years of Rock 'n Roll. The party will be held at its regular venue, in the courtyard of the building housing Akkerman's Toyota. Tickets are available at either City Café or the Mega FM offices on Kaya Gob. N. Debrot for NAFl. 25,-. There are only 600 tickets available, and this event has sold out the last two times. - Then, if that isn't enough, on May 1st, Green Submarine and NetTech will be sponsoring the 6th monthly Underwater Clean-up Dive (that's a half year of clean-up dives, folks!). Meet at 10AM at Green Submarine's dive shop at Kaya Playa Lechi 24, get a free tank and briefing, collect underwater trash, and dine in fine BBQ splendor afterwards. The BBQ is a pot-luck, meaning that while basics (chicken and beverages) are provided, underwater clean-up participants are encouraged to supplement with sharable treats like salads, desserts, etc. If you can't bring food to share, they are also accepting donations to purchase extra items like potato chips for the group. Center for Small Business
Last week, the Stichting Centrum Kleinbedrijf (Small Business Center Foundation) was incorporated. The non-profit agency's main goal is to provide small businesses on Bonaire with information, advice, and training in order to help them survive and grow. Business which qualify for this assistance must have no more than 10 employees, and be no more than three years old.

Under certain conditions, loans will be made available to small businesses, with terms more favorable than those of commercial banks. The Center is an effort by the government, in cooperation with Bonaire's private sector, to stimulate the economy as a whole.

The European Union is providing assistance to this program via the framework of SESNA (Small Enterprise Stimulation program Netherlands Antilles). SESNA advisor Eril Demol is assisting this effort by supporting the Small Business Center and a similar organization already in place on Curaçao. The European Union will assist with the financing of computers and training costs for a period of up to five years.

[Editor's Note: One new small business we'd like to see here on Bonaire would be a "runner service", where a trustworthy individual would take care of running our monthly tax and national insurance payments to the Eilandsontvanger's and the SVB, waiting in line on our behalf. This type of service could also be used to arrange a pick up and/or drop off of other forms and payments and materials. Probably a great opportunity for a hard working entrepreneurial person with a moped or car (and good organizational skills)...]

Copyrights & Trademarks
Being as Internet-focused as we are, we been noticing an alarming trend lately, namely the misuse of copyrighted and/or trademarked materials via electronic means. Because this is an increasingly hot issue, and because all of our readers are Internet users, we'd like to provide an overview of the topic, as well as some ideas on how to protect yourself from the problem.

Copyrights and trademarks are two forms of what's known as intellectual property - property created by one's intellect. A trademark is a "mark" (e.g. a symbol, logo, slogan) used to identify a product, company, or service, while a copyright is any specific "work product" (e.g. written text, photos, graphics design, or art work) which someone creates.

The most common abuse of copyrights and trademarks on the Internet is when people clip text, photos, or graphics from one Web site to use on another Web site or other promotional materials, such as a brochure, without the permission of the owner of the intellectual property. While there is something known as a "fair use" policy with respect to intellectual property, it has a very limited application - basically personal use, and not for promotion, presentation, or publication. In other words, the use of text, photos, or graphics for non-private/non-personal use by people who do not have permission of the copyright/trademark owner to use such items is theft. Such theft occurs most often in ignorance of the law (laws covering the use of intellectual property are international, by the way, as agreed to by virtually all Western countries as part of the Bern Convention a number of years ago). The most common misuse of intellectual property we see is the unauthorized use of photographs and images, and where Bonaire is concerned, those are nature images (underwater photos, photos of flamingos, etc.) and maps.

In some cases, the person stealing the intellectual property is aware of what they are doing, but rationalizes it by virtue of the fact that the image or text they have taken was published on the Internet, so therefore it must be available for the taking. Or, they rationalize that by having changed the text or image in some way (slightly or greatly) that they are not infringing the intellectual property owner's rights. Both of these excuses are incorrect. The first is a matter of willful misinterpretation of law, while the second is what's known as a derivative work product. An original work product is automatically covered by copyright as soon as it is created by its creator, by the way.

This latter item is the cause of a number of major problems however, especially when companies or individuals contract out the services of a writer, photographer, or designer, because these people automatically own the copyright on the work they produce, even if the work was performed for another person or company. The only way to get around this is to have an agreement with such contractors that the person or company contracting the services owns the copyright on any work product the contractor produces. Similar issues apply to employees as well, so it's important for a company which has employees whose job it is to create intellectual property to have them under an employment agreement which grants the employer ownership of all intellectual property the employee creates for the company.

Of course, many contractors assume their clients will own the rights to the work product they produce for the client, but one can't always count on this.

This brings us to the question "How do I know what is copyrighted/trademarked by whom?". It's a question one must know the answer to if one wants to get permission to use copyrighted or trademarked material, or if one wants to inform others that his or her works are protected intellectual property.

Designating a trademark is simple. If it's a common-law trademark (i.e. a non-registered trademark) the first instance needs to be marked with the letters "TM" (Trade Mark), while a registered trademark is designated by a "circle-R" (a circle with an "R" in it). There should also be some language on the product or page indicating who owns such trademarks (see the end of this e-mail for an example).

For copyrights, the best way to designate them is via the following line of text:

               Copyright (c) 1999 by XYZ - All Rights Reserved

One may use either the word "Copyright" or the "Circle-C" (while the "(c)" simulates this, it's actually not legally valid - you should have a "c" inside a circle) to indicate that a copyright is being claimed. The year indicates the first year of the copyright (which, in the U.S., lasts 75 years for companies or the natural life of the copyright holder plus 50 years for individuals), or a range of years. The "XYZ" should be the name of the copyright owner, and the "All Rights Reserved" gives notice that the copyright owner is actively asserting his or her copyright.

We've noticed some work products, including Web pages, which include no copyright statement, or only something vague like "Designed by...". If the page was developed by a contractor for company, then it's possible that the company doesn't own any rights for the work product, and unless that's desired, the company represented by the work product (i.e. Web page) needs to make sure that a copyright notice is displayed at least once per product/page. Otherwise the matter is left up in the air, and one could get an unpleasant surprise when one tries to use the materials elsewhere, i.e. you paid for it, but you have no rights to it.

In conclusion, here are the rules you need to observe when it comes to copyrights and trademarks.

As a person or company designing promotional materials, Web pages, etc. for your own use:

  1. Prominently post notification of ownership for your trademarks and copyrights on your work.
  2. Do not "borrow" or use (modified or unmodified) someone else's work without first getting permission outlining the scope of the use of the work.

As a person or company contracting out for design services for logos, artwork, text, Web pages, newsletters, etc.:

  1. Make sure you have an agreement, preferably in writing, that you own the rights to the final result of all work you are paying to have created.
  2. Prominently post, or have the contractor post, notification of your ownership of trademarks and copyrights on the created works.

- t'Ankertje Closed for Vacation. - Mother's Day - May 9th. Just a reminder to only those people out there who were born. Sunday, May 9th is Mother's Day (Moederdag), and is an appropriate day to treat mothers extra special. Bonaire businesses holding special Mother's Day events should let us at the Bonaire E-News know so we can share a list of such events with out readers. So, here's to you, Mom. - Catch the Races at The Dome. On Sunday, May 2nd, The Dome will be showing the splendor of the Italian Grand Prix on their huge TV. Races start at 8AM Bonaire time. The Dome is located at the corner of Kaya Grandi and Kaya L.D. Gerharts in Kralendijk.

- Internet Advertising. We've been trying to figure out how we can justify the time we spend writing and publishing the Bonaire E-News and maintaining the InfoBonaire Web site (both of which are time consuming), and we've come up with a rather common solution - advertising. As of May 3rd, we will start offering banner advertising on the home page and main category pages of the InfoBonaire Web site ( http://www.InfoBonaire.com ), as well as banner advertising on the Bonaire E-News homepage ( http://www.BonaireENews.com ). Between them, the two Web sites are getting nearly 5,000 visitors a month interested in Bonaire. Prices for individual banner placements will range from $50 - $100/month, and be offered in an 8-position rotation per page, with minimum three month commitment. We will also entertain offers for sponsoring each issue of the Bonaire E-News (which now has over 1,000 subscribers, 60% of whom are off-island). Advertising will only be accepted from businesses or individuals having a connection with Bonaire, such as Bonairean companies, people looking to sell Bonairean property, tour operators, and dive and travel publications.
